According to the marriage law of our country and the specific opinions of the Supreme People's Court on how to determine that the relationship between husband and wife is really broken when the people's court tries divorce cases, combined with some situations in practice, the court generally grants divorce as follows:
(1) bigamy or cohabitation with others;
2. Domestic violence committed by family members;
3. Those who have bad habits such as gambling and drug taking and do not change after repeated education;
4. Having lived apart for two years due to emotional discord;
5. One party has a legally prohibited marriage disease, or one party has physiological defects, or other reasons can not have sexual behavior, and it is difficult to cure;
6. They are lack of understanding before marriage, get married rashly, and have no relationship with husband and wife after marriage, so it is difficult to live together;
7. Concealing mental illness before marriage, failing to recover after marriage, or marrying the other party knowing that the other party is suffering from mental illness before marriage, or one party suffers from mental illness during the period when the husband and wife live together, and fails to recover after a long period of treatment;
8. One party deceives the other party or fraudulently obtains the "marriage certificate" in marriage registration;
9. Arranged marriage, buying and selling marriage, and one party immediately applies for divorce after marriage, or although they have lived together for many years, their relationship has not been established;
10. One party is sentenced to long-term imprisonment according to law, or his illegal or criminal acts seriously hurt the feelings of the husband and wife;
Of course, whether the final court decides divorce or not should be determined by the judge in specific cases.
